Working from home policy in India

Remote work is fully lawful in India, provided it is supported by an employment contract and a clear company policy. Employers are encouraged to create a formal remote working policy that defines the terms of remote employment, ensures compliance with Indian labour laws, and protects both the company and employees.

Standard working hours still apply to remote workers. That’s generally 40 hours per week (up to 9 hours per day with a one-hour break), with overtime capped at 200 hours per year and paid at double the regular wage.

A well-designed remote work policy in India should cover:

  • Eligibility and place of work (e.g. home office or other approved location)
  • Attendance and availability requirements
  • Overtime approval procedures
  • Equipment and expense reimbursement rules
  • Data security and acceptable use of company systems
  • Confidentiality obligations
  • Health & safety self-assessment for the home office
  • Return-to-office triggers in case remote work is withdrawn

Workspace guidelines in India

An appropriate workstation will include the following:

Recommendations for employees working from home:

    Take appropriate breaks every 30 minutes to ensure repetitive actions are not continued for long periods, and stand up at least once per hour

    Stretch and change posture often, and if possible, an alternate activity

    Check that you have a comfortable posture

    Don’t do any lifting, pushing, or carrying type task beyond the physical capacity
