Leave in India

India provides several types of statutory leave to ensure employees have sufficient time off for rest, health, and family responsibilities. Leave entitlements are set under central and state laws, particularly the Shops & Establishments Acts, and vary depending on the state, type of employment, and length of service. In addition to annual leave, employees are entitled to public holidays, sick leave, and maternity leave.

Holiday entitlement

Employees in India are entitled to earned/privilege leave, sick/casual leave, and public holidays. Earned or privilege leave accrues according to state law, typically 15 days per year, with carry-forward and encashment rules varying by state. Sick leave and casual leave are also granted under Shops & Establishments laws, commonly 6–12 days each per year. Public holidays include three mandatory national holidays (Republic Day, Independence Day, and Gandhi Jayanti) as well as state-notified festival holidays.

In addition, each state notifies its own list of festivals and bank holidays, which can add another 7–14 days per year, depending on local practice.

Earned/privilege leave

Usually 12–30 days per year, depending on state rules and length of service. Unused days may be carried forward or encashed, subject to state law.

Sick/medical leave

Typically, 12 days per year, though entitlements vary by state. A medical certificate may be required for more extended absences.

Casual leave

Commonly, 6 days per year, intended for short, urgent personal reasons.

Maternity leave

Women are entitled to 26 weeks of paid maternity leave for the first two children, and 12 weeks for subsequent children, adoption of a child under three months old, or commissioning motherhood via surrogacy.

Paternity leave is not mandated by law in the private sector. Instead, it is governed by company policy.

Adoption/commissioning leave

12 weeks of paid leave in the case of adoption or surrogacy.
